Overview Of The Proposed Settlement

A settlement has been proposed in a class action lawsuit, Seebrook v. The Children’s Place Retail Stores, Inc., Consolidated Case No. 11-cv-00837-CW (the “Action”), pending in the United States District Court for the Northern District of California (“Court”). This Action claims that Children’s Place violated California Civil Code Section 1747.08 (“Section 1747.08”) by requesting and recording Personal Identification Information, including, but not limited to, telephone numbers and email addresses, from customers in its California Children’s Place Stores who paid for purchases with a credit card. Children’s Place denies any wrongdoing and any liability whatsoever, and no court or other entity has made any judgment or other determination of any liability. The Court authorized this Notice. The Court held a hearing to consider whether to approve the Settlement and once the Court enters an order, an update will be posted on this website.

Who is included in the Settlement?

Proposed Class Members include:

All persons who between February 17, 2010 and June 19, 2013 purchased merchandise from any Children’s Place store in the State of California, used a credit card to make the purchase(s), and whose Personal Identification Information, including, but not limited to, any telephone number or email address, was requested and recorded by Children’s Place.

Excluded from the Settlement Class are The Children’s Place Retail Stores, Inc., its subsidiaries and affiliates, and the officers, directors, employees, legal representatives, successors, or assigns of any such excluded persons or entities.

If you excluded yourself from the Settlement, you will not receive a Merchandise Certificate under the Settlement. Excluding yourself was the only option that allowed you to bring your own lawsuit against Children’s Place regarding the allegations in the Action ever again.

Class Members could write to the Court and object to the Settlement by September 17, 2013.


The Fairness Hearing

The Court held a “Fairness Hearing” to consider the Settlement, the request for attorneys’ fees and costs of the lawyers who brought the Action, and the Named Plaintiffs’ request for service awards for bringing the Action on November 7, 2013 at 2:00 p.m. in Courtroom No. 2 of the United States District Court, Northern District of California, located at 1301 Clay Street, Oakland, California 94612.
